This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing counsel for the State.

The petitioner is accused in Cantonment P.S. Case No.70 of 2020 corresponding to G.R. Case No.639 of 2022, pending before the Court of learned S.D.J.M.(S), Cuttack, under Sections 341/307/325/326/506/34 of IPC.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Cuttack, by order dated 29.07.2022 in the aforementioned case, the present BLAPL has been filed.

Taking into account the charge-sheet has already been filed on 14.07.2022 and the release of the co-accused by the learned Sessions Judge, Cuttack in BLAPL No.586 of 2020, this Court directs the petitioner to be released on bail on such terms to be fixed

by the Court in seisin over the matter. It is submitted that the petitioner does not have any criminal antecedent. 6.

While releasing the petitioner on bail, learned court in seisin over the matter shall verify such assertion and if it comes to the fore that he has any criminal proclivity, this order shall stand recalled.

Accordingly, the BLAPL stands disposed of.
