Considering that there is already a scope available with the Order No.
Petitioner to defend his case in the original proceeding and as the mutation appeal is already disposed of with an order of remand, this Court is not inclined to entertain the writ petition. It is at this stage of the matter Mr. Sahoo, learned counsel for the Petitioner does not want to press this Writ Petition.

The writ petition is, accordingly, dismissed as not pressed. It is, however, open to the Petitioner to place his case in the original proceeding on the allegations raised in the appeal. (Biswanath Rath) Judge Ayaskanta Jena
