This matter is taken up through hybrid mode.

None appears for the Petitioner at the time of call. 3.

On verification of the case record, it appears that certified copy of the impugned order is not filed.

It appears that on 4th August, 2022, an adjournment was sought for on behalf of the Petitioner to serve a copy of the CMP on learned State Counsel. Today, none appears on behalf of the Petitioner to pursue the matter.

It further appears from the case record that the Petitioner assails the order dated 20th May, 2022 passed by learned Civil Judge (Senior Division), Bhubaneswar in I.A. No.1 of 2022, whereby an application under Order XXXIX Rule 3 C.P.C. was rejected.

In view of the above, this Court feels that the Petitioner has lost interest in pursuing the CMP.

Accordingly, the CMP is dismissed for non-prosecution. (K.R. Mohapatra) ms Judge
