This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in C.T. Case No.42/31 of 2022 (POCSO) arising out of Kesinga P.S. Case No.42 dt. 29.01.2022, pending in the Court of the learned Additional Sessions Judge - cum- Special Court under POCSO Act, Bhawanipatna, for alleged commission of offences under Sections 363/366/376(2)(n)/376(3) of IPC read with Section 6 of the POCSO Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge -cumSpecial Court under POCSO Act, Bhawanipatna, by order dated 12.07.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the State that notice has been served on 04.09.2022. There is no appearance on behalf of the informant/victim.

Perused the 164 Cr.P.C. statement produced by the learned counsel for the State.

Taking into account that the petitioner is in custody since 04.04.2022 and charge-sheet has already been filed on 22.05.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 8.
Accordingly, the BLAPL stands disposed of.
