This matter is taken up through Hybrid mode.

This CMP has been filed assailing orders dated 25th July, 2022 (Annexure-4 series) and to implead the Petitioners as parties in both RFA No.8 of 2005 / IA No.24 of 2005 by substituting them in place of deceased Appellant No.1(d)/ Petitioner No.1(d), namely, P.Swarnalata Prusty respectively. 3.

In course of hearing, learned counsel for the Petitioners prays for withdrawal of the CMP to file appropriate application before the learned appellate Court to implead them as parties to the appeal and files a memo to that effect, which is taken on record.

This Court, without expressing any opinion on merit of the submission made by learned counsel for the Petitioners, disposes of the CMP as withdrawn.
