Heard Mr. S. Rath, learned Additional Standing Counsel appearing for the State opposite parties. 4.

Perused the record. It appears that the petitioner has filed this writ petition seeking direction to the opposite parties to return the excess amount taken by the competent authority towards royalty for non-operation period of Benapura II Sand Source within the period of operation till 2022 and further to issue direction to opposite party no.3 to dispose of the pending appeal taking into note the claim of the petitioner.

Since the petitioner claims for refund of excess amount taken by the authority towards royalty, this Court is not inclined to entertain this writ petition. However, it is open to the petitioner to pursue his remedy before the appropriate forum ventilating his grievances in terms of the

agreement/DTCN which is applicable to them.

Accordingly, the writ petition stands disposed of granting liberty as aforesaid.
