This matter is taken up through hybrid mode.

The Petitioner in this writ petition seeks for a direction to restrain the Opposite Parties more particularly Opposite Party Nos.2 and 3, namely, Executive Officer, Kendrapara Municipality and Executive Engineer (Irrigation), Kendrapara from making any construction over the land of the Petitioner in Plot No.162/1904 under Khata No.479/550 situated in mouza Khadianga in the district of Kendrapara.

Since the Petitioner has a remedy under the common law forum to ventilate his grievances, this Court is not inclined to entertain the writ petition at this stage.

Accordingly, this writ petition is disposed of with an observation that the Petitioner, if so advised, may avail the remedy in accordance with law.

Urgent certified copy of this order be granted on proper application.
