This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned counsel for the State. Perused the record as well as F.I.R. 3.

This is an application under Section 439 of the Criminal Procedure Code.

The Petitioner is an accused in Special G.R Case No.70 of 2020 on the file of learned Additional Sessions Judge-cum-Special Judge, Jagatsinghpur for the commission of offences punishable under Sections 448/363/365/323/294/376(2)(n)/376(3)/506, I.P.C. read with Section 3(1)(r)(s)/3(w)(i)/3(2)(v) of the S.C. and S.T. (POA) Act read with Section 6 of the POCSO Act. 5.

Considering the submissions and the materials placed before the Court, I am not inclined to release the Petitioner on bail. Accordingly, the bail application stands rejected. 6.

However, considering the facts and circumstances of the case

// 2 // and the period of detention of the Petitioner and the fact that trial commenced and some of the witnesses have been examined by the learned trial court. Learned trial court is directed to make an endeavour to conclude the trial of this case as expeditiously as possible preferably within a period of six months hence. 7.

With the aforesaid observation, the bail application stands disposed of.
