Considering that the application of the Petitioner for removal of unauthorized encroachment vide Annexure-4 (series) is still pending before the Opposite Party Nos.2 & 3, this Court directs the Opposite Party Nos.2 & 3 to first find-out their jurisdiction over such matter and thereafter take decision as appropriate on the aspect of clearing of encroachment over the disputed property in question, but however, involving the parties likely to be affected. 2.

The entire exercise shall be completed within a period of four months from the date of communication of an authenticated copy of this order by the Petitioner.

It is further directed that in the event any such application for interim protection is filed, dependent on the situation and the observation in the preliminary inquiry order as appropriate on the protection of the disputed property shall be passed.
