Mr. Rout, learned advocate appears on behalf of petitioner and submits, impugned is order dated 19th July, 2022 made by Collector-Cum-Chairman, SS, Kendrapara. By it the authority rejected his client's claim in regard to 350 Non-Residential Bridge Course (NRBC) Centers being run by it and seeking grant-in-aid.

Mr. Acharya, learned advocate, Standing Counsel of the department appears and submits, several times petitioner has moved before this Court, by earlier writ petition and in contempt. Petitioner-organization did not produce any document before the Collector. The writ petition does not disclose a substantial cause of action. It be dismissed. He submits further, in event the petition is not dismissed in limine, his client be given opportunity to file counter.

Perused impugned order. Reason given thereby for rejection of petitioner's claim to obtain grant-in-aid appears to be stated in the sentence extracted from the order and reproduced below.

"xx xx xx As such the 350 NRBC centres run by the United Samiti Action, NGO, Pattamundai have not been approved by the State Level Grant in Aid Committee (SLGIAC) to release the fund. xx xx xx"

Mr. Rout relies on circular dated 9th July, 2009, whereby office of State Project Director, Odisha Primary Education Programme Authority had required all Collectors, as being authorized, to select credible NGOs regarding running, inter alia, NRBCs. By letter dated 11th March, 2010 Collector, Kendrapara said, inter alia, as follows. "In inviting a reference to the letter on the subject cited above I am to permit the NGO, United Samiti Action, Pattamundai for oprationalisation of NRBC centre at Rajnagar & Pattamundai area as per experienced aforesaid scheme and the permission is accorded to implement NRBC centres as per required format. The work of NGO is satisfactory for implementation of the N.R.B.C. scheme."

Letter dated 4th August, 2012 from District Inspector of Schools, Pattamundai to Director, Elementary Education is also relied upon by Mr. Rout.

Opposite party no.1 through the State Level Grant-inaid Committee (SLGIAC) will consider petitioner's case afresh of running NRBC(s), reported to be so on the ground by the Collector and the D.I. since, by impugned order the

// 3 // Collector has rejected its claim based on lack of approval by the Committee. This direction for the Committee to reconsider is on the ground reports of NRBCs being run satisfactorily by petitioner.

Decision taken by the Committee is to be made known to petitioner within four weeks of communication. 7.

The writ petition is disposed of.
