This matter is taken up through hybrid mode.

The grievance of the Petitioner in this writ petition is with regard to inaction of the Regional Transport Officer, Cuttack-Opposite Party No.2 in allowing transfer of ownership of the vehicle bearing Registration No.OAC 0723 (Bullet) in his favour. He also prays for a direction to set aside the Letter No.2148 dated 12th June, 2020 (Annexure-5) issued against him.

In course of hearing, Mr. Gupta, learned counsel for the Petitioner prays for withdrawal of the writ petition submitting that the Petitioner will pursue the matter before the Authority under the Motor Vehicle Act, 1988 and Rules framed there under. He, however, prays for a direction that delay in filing the proceeding before the Authority to be considered liberally.

In view of such submission, this writ petition is disposed of as withdrawn with an observation that if the Petitioner files appropriate proceeding before the Authority under the Act within a period of two weeks hence, delay in filing the same may be considered liberally keeping in mind the pendency of the writ petition before this Court from 7th September, 2020 till date along with other grounds.

Urgent certified copy of this order be granted on proper application.
