Heard Mr. S. Ray, learned Counsel for the Petitioner. 3.
The Petitioner has filed this Writ Petition seeking direction to the Opposite Parties to call upon the petitioner for opening of price bid along with other technically qualified bidders and then consider for the award of the Contract "Up-gradation of Main Hoist Drive System of 250 T Hot Metal Handling Cranes (4 Nos.) at SMS-II of RSP.

Mr. S. Ray, learned Counsel for the Petitioner contended that the Opposite Parties invited tender vide Annexure-1, pursuant to which the Petitioner participated in the tender process. But for the reason known to the Authorities, the petitioner was called upon to produce some documents vide Annexure-8, which was complied by the Petitioner. But, without considering the same, the Opposite Parties opened the price bid.

As it appears, the Petitioner has not made out a case, by filing documents that it was qualified in the technical bid. Therefore, the Petitioner has filed this Writ Petition on
apprehension. In absence of such document, the Writ Petition is not maintainable before this Court. However, liberty is granted to the Petitioner to approach the appropriate forum, in the event it gets documents with regard to the fact that it has qualified in the technical bid.

With the above observation, the Writ Petition stands disposed of.
