As it appears, instead of submitting their grievances for consideration of the competent authority, the Petitioners have straightway approached this Court involving a notice of eviction U/s.252, 254 & 275 (A) of the O.M. Act, 1950. This Court records the submission of Mr. Panda, learned counsel for the Petitioners that there has been no action on the notice of eviction vide Annexure-3 as of now.

In the circumstance and as there is no eviction of the Petitioners as of now, it is open to the Petitioners to raise their objection before the Executive Officer, Nayagarh Municipality within a period of seven working days hence. It is directed that in the event any such objection at the instance of the Petitioners is filed before the Executive Officer, Nayagarh Municipality in response to the notice of eviction vide Annexure-3 within the time stipulated

// 2 // hereinabove, the same shall be considered and disposed of with communication of the outcome therein to the Petitioners. It is further directed that till a decision is taken on the objection of the Petitioners by the Executive Officer, Nayagarh Municipality, there shall be status quo in respect of the disputed property in question to be maintained by all the parties concerned.
