Heard Mr.S.D.Das, learned senior counsel appearing for the petitioner.

This writ petition involves the following prayer: "The petitioner, therefore, pray that, this Hon'ble Court may graciously be pleased to issue Rule NISI, calling upon the Opp. Parties, to show cause as to why a writ of mandamus or any other appropriate writ or writs shall not be issued;

(i) Directing the Opp. parties more particularly the opposite parties Nos.2 and 4, to handover the allotted shop room of the Gram Panchayat in favour of the petitioner.

(ii) Further direct the opp. party no.2/Collector, Balasore to dispose of the grievance of the petitioner relating to the handling over possession of the shop room allotted by the Gram Panchayat in favour of the petitioner. (iii) If the opp. parties fail to show cause or show insufficient cause, to make the said Rule absolute.

(iv) And to pass such other order/orders, writ/writs as would afford complete relief to the petitioners.

And for this act of kindness, the petitioners shall as in duty bound remain ever pray.

3. In the above backdrop of submission, this Court finds similar request is also pending before the Collector, Balasore-opposite party no.2. Keeping in view the pendency of the request at the hand of the competent authority, in disposal of the writ petition this Court straightway directs the Collector, Balasore-opposite party no.2 to take a lawful decision on Annexure-5 at least within a period of two months
