Heard learned counsel for the petitioner, learned counsel for the State and learned counsel for the informant. 2.

The petitioner is an accused in S.T. No.11 of 2022, pending in the Court of the learned 1st Additional Sessions Judge, Rourkela, arising out of Brahmanitarang P.S. Case No.227 of 2021, for commission of alleged offences under Section 302/34 of IPC. 3.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 1st Additional Sessions Judge, Rourkela, by order dated 10.05.2022 in the aforementioned case, the present BLAPL has been filed.

Since the learned Court in seisin was moved on account of passing away of the mother of the petitioner, this Court is not inclined to entertain this bail application.

Accordingly, the BLAPL stands disposed of.

Liberty is given to the petitioner to move the learned Court in seisin afresh, which shall be considered on its own merits. (V. NARASINGH) Judge Ayesha
