This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in Puruna Katak P.S. Case No.80 of 2022 corresponding to Special Case No.24 of 2022, pending in the Court of learned Sessions Judge-cum-Special Judge, Boudh, under Section 20(b)(ii)B of NDPS Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge-cum-Judge Special Court, Boudh, by order dated 07.07.2022 in the aforementioned case, the present BLAPL has been filed.

Admittedly since the seizure of the contraband (ganja) to the tune of 16 kgs. is less than the commercial quantity as prescribed and it is also submitted by the learned counsel for the petitioner that charge-sheet has already been filed in the meanwhile,
this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter. 6.
Accordingly, the BLAPL stands disposed of.
