This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned Additional Standing Counsel for the State.

The petitioner is an accused in Jujumura P.S. Case No.183 of 2021 corresponding to S.T. Case No.28 of 2022, pending in the file of learned Sessions Judge, Sambalpur, under Sections 302 of IPC.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Sambalpur, by order dated 18.07.2022 in the aforementioned case, the present BLAPL has been filed.

Taking note from the rejection order that trial has commenced, this Court is not inclined to entertain this bail application of the petitioner at this stage notwithstanding the
submission of the learned counsel for the petitioner that the witnesses examined so far as do not implicate the petitioner. 6.
Since the petitioner is stated to be in custody from 26.12.2021, learned Court in seisin over the matter is called to conclude the trial within the period of three months from the date of receipt/production of copy of this order.

It shall be open to the petitioner to renew his prayer for bail, in the event the trial is not concluded within the time frame. 8.
Accordingly, the BLAPL stands disposed of.
