This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is accused in PR Case No.50 of 2022-23 corresponding to 2(a)CC Case No.608 of 2022, pending before the learned J.M.F.C.(R), Cuttack, Under Section 52(a) of Odisha Excise Act, 2008.

Being aggrieved by the Rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge, Cuttack, by order dated 01.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the rejection order.

Taking into account the nature of allegation, punishment prescribed and period of custody from 22.07.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
