This matter is taken up through Hybrid Arrangement Order No.
(Virtual/Physical Mode).

This interlocutory application has been filed by the Petitioner for modification of the order dated 26.08.2022 passed by this Court in the aforesaid bail application. 3.
Heard learned counsel for the Petitioner.

It is submitted by the learned counsel for the Petitioner that on the self-same facts, initially making out of a case under Section 363 read with Section 34 of the I.P.C., this Court has granted bail to the Petitioner vide order dated 26.08.2022. He further contended that while granting bail to the Petitioner, this Court had taken note of the statement of the victim girl recorded under Section 164 of Cr.P.C.
However, after investigation while filing the charge sheet, offences under Sections 366/379 of I.P.C. have been added to Section 363 of I.P.C.

On perusal of the materials available on record, this Court is inclined to modify the order dated 26.08.2022 and in the 4th paragraph of the order, the following line be added:- "After investigation charge sheet has been filed under Sections 363/366/379 of the I.P.C."

Further, in view of the aforesaid modification, the time to surrender before the Court in seisin over the matter is extended by a further period of four weeks subject to deposit a sum of Rs.1,000/- (Rupees one thousand) in the Advocates' Welfare Fund of the Orissa High Court Bar Association within fifteen days hence and furnishing money receipt thereof in proof of deposit.

The I.A. is disposed of.

Urgent certified copy of this order be granted on proper application.
