This matter is taken up through hybrid mode.

The Petitioner has filed this writ petition assailing forceful seizure of his vehicle bearing Registration No.OD-04N-5079 (Truck) by Opposite Party No.2 due to non-payment of the defaulted amount.

Mr. Manas Ranjan Khatua, learned counsel enters appearance on behalf of Financer-Opposite Party No.2 by filing Vakalatnama in Court today, which is taken on record. He submits that on payment of 50% total outstanding loan dues pursuant to the direction of this Court in W.P.(C) No.2900 of 2022, the aforesaid vehicle has been released in favour of the Petitioner. However, the Petitioner has not paid the rest of rephasement amount. Hence, the prayer made in this writ petition should not be granted.

Considering the submission made by learned counsel for the Financer-Opposite Party No.2 and the fact that the Petitioner has not complied with the order passed in W.P.(C) No.2900 of

// 2 // 2022, this Court is not inclined to entertain the writ petition. Accordingly, this writ petition stands dismissed. Urgent certified copy of this order be granted on proper application.
