05.04.2024 I.A. No.1600 of 2023 12.

This matter is taken up through Hybrid arrangement (video conferencing/physical mode). This interim application has been filed for waiving out condition no.(iv) in the order dated 16.02.2022 passed in BLAPL No.6494 of 2021.

The condition no.(iv) reads as follows:- <(iv) the petitioner shall not leave the State of Odisha without prior permission of the Court concerned;= As per the order dated 06.03.2024, the Inspector in-charge of C.I.D., Crime Branch, Cyber Crime police station has filed an affidavit opposing

the prayer made in the interim application.

After hearing the learned counsel for the respective parties and on going through the averments taken in the interim application and the affidavit filed by the Inspector in-charge, I am inclined to modify the condition no.(iv) of the bail order dated 16.02.2022 to the extent that the petitioner shall leave the State of Odisha with due intimation to the Superintendent of Police, Crime Branch and he will give the details of places of visit, the period of visit, the address where he will stay, his mobile number and after returning, he would also report to the Superintendent of Police, Crime Branch and during such period, he shall not try to contact with any of the prosecution witnesses. The rest part of the order dated 16.02.2022 remains unaltered.

With the aforesaid modification, the I.A. is disposed of.

A free copy of this order be handed over to the learned counsel for the State.

Urgent certified copy of this order be granted on proper application.
