2. Heard learned counsel for the Petitioner.

The petitioner has filed this writ petition with the following prayer:- "To direct the Executive Officer, Jharsuguda Municipality, Jharsuguda for release of retirement benefit, Pension, Gratuity, Un-utilized leave salary and Group Insurance amount within a specific period since present petitioner retired as Driver in the year 2017 before Municipal Officer, Jharsuguda and further be pleased to consider the representation dated 05.05.2022 along with application with required documents for release of pension in prescribed form-VII under Rule-78 of Odisha Municipality Employees (Pension) Rules, 1989 dated 10.07.2017 within a specific period".

The Petitioner has moved before Opposite Party No.2 seeking redressal of his grievances as made in the representation under Annexure-3 to the Writ Petition.

Considering the submissions made and without expressing any opinion on the merits of

// 2 // the case, this Court directs Opposite Party No.2 to take a decision on the above noted representation of the petitioner, in accordance with law within a period of three months from the date of receipt of certified copy of this order and communicate the result thereof to the Petitioner.

With the aforesaid observation and direction the Writ Petition is disposed of.
