This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioner is an accused in connection with C.T. Case No. 238 of 2022 arising out of Balasore Sadar P.S. Case No. 110 of 2022, pending on the file of the learned JMFC(R ), Balasore for the alleged commission of offence under Section 379 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Addl. Sessions Judge, Balasore by Order dtd.23.07.2022, the present BLAPL has been filed.

Perused the order of rejection.

Taking into account the nature of allegation, punishment prescribed and period of custody since 12.07.2022, this Court directs the petitioner to be released on

bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally, it is directed that the petitioner shall appear before the jurisdictional Police Station once every week till conclusion of the investigation.

The BLAPL thus stands disposed of.

8.

Urgent certified copy of this order be granted as per rules.
