Heard Mr. M. Mohanty, learned counsel for the Petitioners and Mr. P.P. Mohanty, learned Additional Government Advocate appearing for the State Opposite Parties.

The Petitioner has filed this Writ Petition seeking to quash clause-8 of the notification bearing no. 4828 dated 11.07.2022 under Annexure-4 issued by Opposite Party No.3 and to issue direction to the Opposite Parties to pass appropriate order for retender the Sand Sairat of Khaira Mahanadi Sand Quarry by amending Clause-8 of Annexure-4 in consonance with para-2 of notification dated 31.03.2022 under Annexure-1 and further to direct Opposite Party No.3 to dispose of the representation dated 11.07.2022 under Annexure-3 within a stipulated period. 4.

In course of hearing, learned counsel for the Petitioner states that highlighting the grievances, the Petitioner has made a representation to Opposite Party No.3 vide Annexure-3 and the same may be directed to be considered within a stipulated time, to

which learned counsel for the State has no objection. 5.

As agreed to by learned counsel for the parties, this Court, without expressing any opinion on the merits of the case, disposes of the writ petition directing Opposite Party No.3 to consider the representation filed by the petitioner vide Annexure-3, and pass appropriate order in accordance with law after giving personal hearing to the Petitioner within a period of four weeks from the date of production of certified copy this order. 6.
