This matter is taken up through hybrid mode.

It is stated by the learned counsel for the Petitioner that the Petitioner, who is an employee of the Railway Department, has expired during pendency of this Criminal Misc. Case. 3.

Charge sheet in this case has been submitted and cognizance has already been taken.

Since Petitioner has already died, the Criminal Misc. Case against him abates.

5.

However, the trial court shall obtain a report in this regard before abatement of the criminal case pending and then pass necessary order.
