This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioner is an accused in connection with G.R. Case No. 855 of 2022 arising out of Motanga P.S. Case No. 153 of 2022, pending on the file of the learned SDJM, Dhenkanal, for the alleged commission of offence under Section 341/294/307/326 of the I.P.C.

Being aggrieved by the rejection of his application for bail U/s. 439 Cr.P.C. by the learned Addl. Sessions Judge, Dhenkanal by Order dtd.2.08.2022, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that though the accusation is under Section 307 I.P.C., in the meanwhile Charge Sheet has been filed on 29.07.2022 and the injured is leading a normal life.

Taking into account the filing of Charge Sheet and keeping in view the period of custody since 2.07.2022, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.

Additionally, it is directed that the petitioner shall appear before the jurisdictional Police Station once every week till conclusion of the trial.

The BLAPL thus stands disposed of.

Urgent certified copy of this order be granted as per rules.
