Heard learned counsel appearing for the parties. 2.

The application has been brought solely on the premises that there has been wrong procedure adopted by the election court even by bringing a person no way connected with the election process. This Court observes in the event there is calling of such person and recording of such evidence, nothing prevented the elected candidate to defend his case even involving such evidence therein. This Court therefore finds no substance in entertaining the writ petition expect provides opportunity of contesting such evidence at appropriate stage in appropriate manner in trial proceeding.

The writ petition stands disposed of with the observation made hereinabove.
