This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with OIC of Excise District Mobile Phulbani P.R. No. 26 of 2022 corresponding to 2(a) CC Case No. 17 of 2022, pending on the file of learned Sessions Judge-cum-Special Judge, Phulbani under Sections 20(b)(ii)(B) of N.D.P.S. Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge, Phulbani by order dated 26.07.2022, the present BLAPL has been filed. 5.
Perused the order of rejection.

Considering the quantity of contraband seized to the tune of 18 Kgs. of contraband (Ganja), which is admittedly less than commercial quantity and the period of custody 21.07.2022, this
Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.
Additionally, it is directed that he shall appear before the jurisdictional Police Station once every month till conclusion of trial.
8.
Violation of such appearance shall entail cancellation of bail.
9.
Accordingly, the BLAPL stands disposed of.
