Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in connection with Jaleswar P.S. Case No. 193 of 2022 corresponding to Special Case No. 115 of 2022, pending on the file of learned Sessions-cum-Special Judge, Balasore, under Sections 20(b)(ii)(C) of N.D.P.S. Act. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Special Judge, Balasore by order dated 3.06.2022, the present BLAPL has been filed. 5.

The consideration by the learned Court in seisin over the matter was during the course of investigation. 6.

The petitioner is at liberty to move the learned Court below after filing of Charge-Sheet. The same shall be considered on its

own merit without being influenced by the earlier rejection order or the order passed by this Court.

The Bail Application thus, stands disposed of. 8.
