This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioner is an accused in connection with G.R. Case No. 117 of 2022 arising out of Tarava P.S. Case No. 122 of 2022, pending on the file of the learned JMFC, Tarava for the alleged commission of offence under Sections 380 of the I.P.C.

Being aggrieved by the rejection of their application for bail U/s. 439 Cr.P.C. by the learned Sessions Judge, Sonepur (I/C) by Order dated 29.06.2022, the present BLAPL has been filed.

Taking into account the nature of allegation and filing of Chare-sheet, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin

over the matter so as to ensure his presence on each date of trial.

Considering the criminal proclivity of the petitioner and noting the submission of the learned counsel for the State, there is no recovery of cash of Rs.90,000/-(Rupees ninety thousand) which is involved in this case at hand. While fixing the terms the learned court in seisin over the matter shall direct the petitioner to furnish cash security of Rs.50,000/-(Rupees fifty thousand) which shall be kept in shape of short term interest bearing account in any nationalized bank, pledged to court in seisin over the matter and shall abide by the result of the case at hand. Further one of the sureties shall be the immediate family member of the petitioner. 9.

The BLAPL thus stands disposed of.

Urgent certified copy of this order be granted as per rules.
