According to Mr.Mohapatra, learned counsel for the petitioner the petitioner is aggrieved by construction of a road on his Plot No. 123 pertaining to Khata No. 51 and Plot No. 124 pertaining to Khata No. 209 of village Tilia under RI Circle Sagabahal of Balisankara Tahasil in the district of Sundergarh without acquiring the same in accordance with law. He further submits that though highlighting all the grievances the petitioner has filed a representation before Collector & District Magistrate, Sundargarh (opposite party No.2) on 2.8.2021 vide Annexure-5 which was sent through registered post however till date nothing has been done in the matter. In such background, he prays that a direction be issued to opposite party No.2 to take a decision on the above representation dated 2.8.2021 under Annexure-5 within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs the Collector & District Magistrate, Sundargarh (opposite party No.2) to take a decision on the above noted representation dated 2.8.2021 under Annexure-5 in accordance with law within a period of eight weeks from the date of receipt of copy of this order and communicate the result of such exercise to the petitioner.

The writ petition is accordingly disposed of. 6.

Urgent certified copy of the order be granted on proper application.
