This matter is taken up through Hybrid Mode.

Heard learned counsel for the parties.

The petitioners are accused in connection with G.R. Case No. 1594 of 2022 arising out of Jagatpur P.S. Case No. 252 of 2022, pending on the file of the learned JMFC(R), Cuttack for the alleged commission of offence under Sections 379/34 of the I.P.C.

Being aggrieved by the rejection of their application for bail U/s. 439 Cr.P.C. by the learned 1st Addl. Sessions Judge, Cuttack, by Order dated 3.08.2022, the present BLAPL has been filed.

The allegation in the case at hand that the petitioners have committed theft of Rs.2, 00,000/-(Rupees two lakhs). 6.
Learned counsel for the State submits that the petitioners have been identified in the T.I.Parade and
Rs.29,000/-(Rupees twenty nine thousand) was recovered from them.

Taking into account the nature of allegation and punishment prescribed, this Court directs the petitioners to be released on bail on such terms to be fixed by the learned Court in seisin over the matter so as to ensure their presence on each date of trial.

Additionally it is directed that the petitioners shall furnish cash security of Rs.1,00,000/-(Rupees one lakh) which shall be kept in shape of short term interest bearing account in any nationalized bank, pledge to court in seisin over the matter and shall abide by the result of the case at hand. 9.
The BLAPL thus stands disposed of.

Urgent certified copy of this order be granted as per rules.
