This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

This Interlocutory Application has been filed seeking modification of order dated 03.11.2022 passed in BLAPL No.7564 of 2022.

It is submitted by the learned counsel for the Petitioner that it was detected that the Petitioner is involved in another case of similar nature.

Learned Additional Standing Counsel for the State on the other hand submitted that the other case is also under the same Police Station. However, considering the fact that the Petitioner was arrested in a public place and he was in custody since 04.02.2021 this Court was inclined to grant bail vide order dated 03.11.2022. 5.

Considering the submissions made by the learned counsel for

// 2 // the Petitioner, this Court is inclined to modify the condition with regard to criminal antecedents of the Petitioner. Accordingly, Para12 is modified to the extent that in the event the Petitioner has more than one criminal antecedent then this order shall not be given effect to. Further, in view of the aforesaid modification, the Clause- (iv) of Paragraph-10 of the order also stands modified to the extent that the Petitioner shall appear once in a week before the concerned Police Station as has been directed vide order dated 03.11.2022 till conclusion of the trial. The other terms and conditions of the order dated 03.11.2022 shall remain intact.

The I.A. is accordingly disposed of.
