Heard learned counsel for the petitioner and learned Standing Counsel for the State.

The petitioner was engaged as Jogana Sahayak in Dhaulimuhan Gram Panchayat. By order dated 03.01.2022, he was withdrawn from his official work on administrative ground by the BDO, Khordha Block. Challenging such order, the petitioner had approached this Court in W.P.(C) No. 5806 of 2022. By order dated 12.04.2022 this Court directed the BDO, Khordha to dispose of the petitioner's representation within a period of one month. Pursuant to such order, the representation of the petitioner was considered and he was reinstated as Jogana Sahayak of Dhaulimuhan G.P. by order dated 02.06.2022 passed by the B.D.O., Khordha and accordingly on 03.06.2022, the petitioner submitted a joining report.

It is submitted that because of political pressure, though the petitioner was allowed to join, yet he was not allowed to perform his duties. As such ventilating his grievance, the petitioner

submitted a representation on 18.07.2022 in the grievance cell of the Principal Secretary to Government in Food Supply and Consumer Welfare Department. The same is said to be pending. 5.

Since a representation has been submitted and it is for the concerned authority to take a decision thereon, without expressing any opinion on the merits of the case, the writ petition is disposed of with a direction to the Principal Secretary to Government in Food Supply and Consumer Welfare Department to consider the representation and to dispose of the same by passing a lawful order within a period of three weeks from the date of communication of this order or on production of certified copy thereof by the petitioner.

Further the Principal Secretary shall also consider the fact that the petitioner has not been paid his salary. If the same is found to be correct, necessary orders shall be passed to release his salary without any further delay.
