This matter is taken up through Hybrid mode.

Petitioner in this writ petition seeks to assail the initiation of proceeding under Section 135 of the Electricity Act, 2003 (for short, 'the Act').

Mr. Dash, learned counsel, who has instruction to appear on behalf of the Opposite Party-TPCODL, submits that the proceeding under Section 135 of the Act has already been disposed of on 5th September, 2022 by a speaking order. 4.
Mr.Mohapatra, learned counsel for the Petitioner therefore submits that the Petitioner may be permitted to amend the writ petition to assail the final assessment order passed under Section 135 of the Act.

In view of the fact that final assessment order has been passed, the writ petition has become infructuous.

Accordingly, the writ petition disposed of as infructuous. Petitioner, if so advised may challenge the final order of assessment under Section 135 of the Act by taking recourse to law.
