This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.545 of 2022, on the files of learned S.D.J.M. Bhawanipatna, arising out of Kegaon P.S. Case No.93 of 2022, under Sections 379 of IPC. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Kalahandi, Bhawanipatna, by order dated 14.07.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that he has been remanded in the case at hand on 04.06.2022 only because of his criminal proclivity.

Perused the order of rejection.

Taking into account the nature of allegations and the punishment prescribed, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Keeping in view the criminal proclivity of the petitioner, this Court directs that petitioner shall appear before the jurisdictional Police Station twice a week till the submission of final form and one of the sureties shall be his immediate family member. 9.

Accordingly, the BLAPL stands disposed of.
