Heard Mr. N. panda, learned counsel for the petitioner and Mr. H.M. dhal, learned Additional Government Advocate. 2.

According to Mr. Panda, the father of the petitioner was occupying a Government land i.e. Plot No.497 pertaining to Khata No.218 in mouza-Dhamantira under Nimapara Tahasil of Puri District since 1980 and according to him, the said piece of land is not being settled with the petitioners under the provisions of the Odisha Government Land Settlement Act, 1962 though they are otherwise eligible for such settlement. 3.

During course of hearing, Mr. Panda submits that liberty may be granted to the petitioners to file an appropriate application under the Orissa Government Land Settlement Act, 1962 and the rules made thereunder before the Tahasildar, Nimapara (opposite party No.4) for redressal of their grievances. He further submits that the said opposite party be directed to take a decision on such motion within a specific time period.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court grants liberty to the petitioners to file an appropriate petition before opposite party No.4 under the provisions of above noted Act and Rules within a period of two weeks from today. In the event, such an application is received in appropriate form along with a copy of this order, the opposite party No.4 is directed to take a decision on the same in accordance with law within a period of six months from the date of receipt of such application if there is no other legal impediment and communicate result of such exercise to the petitioner No.1, who in turn is directed to share such information with other petitioners. 5.

Accordingly, this writ petition is disposed of. 6.

Urgent certified copy of this order be granted on proper application.
