This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.2435 of 2022, pending in the file of learned S.D.J.M., Sambalpur, arising out of Ainthapali P.S. Case No.359 of 2022, offence under Sections 408/468/417 of IPC and is in custody since 06.07.2022. 4.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, Sambalpur by order dated 03.08.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the petitioner that accused with greater complicity that is one Chandra Kanta Rout has been released on anticipatory bail by this Court by order dated 26.08.2022 in ABLAPL No.8642 of 2022.

Learned counsel for the State on the basis of recitals in the Case Diary submits that the petitioner has lesser complicity than Chandra Kanta Rout.

Taking note of the same and keeping in view that the petitioner is in custody since 06.07.2022 and investigation has progressed substantially, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Additionally it is directed that the petitioner shall appear before the Investigating Officer station once every week till the submission of final form.

Accordingly, the BLAPL stands disposed of.
