This matter is taken up through hybrid mode.

Heard learned counsel for the Petitioner and learned counsel for the State.

The Petitioner is an accused in C.T. Case No.260 of 2022 pending in the file of learned J.M.F.C., M. Rampur, arising out of M. Rampur P.S Case No.166 of 2022, for commission of offence under Sections 141/294/323/325/307 IPC and is in custody since 06.07.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Sessions Judge, I/C, Kalahandi, Bhawanipatna by order dated 27.07.2022 in the aforementioned case, the present BLAPL has been filed.

It is submitted by the learned counsel for the Petitioner that the injured in the meanwhile is leading a normal life and as charge sheet has been filed, he may be released on bail.

Learned counsel for the State opposes the prayer for bail of the Petitioner, inter alia, on the ground that the manner in which the assault has been made, the Petitioner is not entitled to be released on bail.

Considering the well being of the injured and taking into account the wife of the Petitioner stated to be suffered from illness, this Court directs the Petitioner to be released on bail on such terms to be fixed by the learned court in seisin over the matter. 8.
Additionally, it is directed that the Petitioner shall appear before the jurisdictional police station of the Court in seisin over the matter once every week till conclusion of final form. 9.
Accordingly, the BLAPL stands disposed of.
