Heard Mr. S. Jena, learned Standing Counsel appearing for School and Mass Education Department. 3.
The Petitioners- State have filed this Writ Petition to quash the order dated 09.01.2015 under Annexure-2 passed in O.A. No. 2183/2014, by which the Orissa Administrative Tribunal, Principal Bench, Bhubaneswar, while quashing the Order dated 11.08.2014, directed the Petitioners to consider for grant of 2nd/3rd ACP after completion of 25/30 years of service from the date of initial appointment of Opposite Party No. 1 within a period of four months from the date of receipt of the copy of the Order and pay the arrears of pay and pensionary benefits, as due and admissible to him, within a period of two months thereafter.

Mr. S. Jena, learned Standing Counsel appearing for School and Mass Education Department contended that O.A. No. 2183 of 2014 was heard along with O.A. NO. 2182 of
2014 and batch, which were disposed of vide common order dated 09.01.2015. Against the Order dated 09.01.2015 passed in O.A. No. 2182 of 2014, the State filed W.P.(C) No. 9060 of 2016. This Court, after due adjudication, dismissed the said Writ Petition vide Order dated 05.04.2017. Since Opposite Party No. 1 is covered by the ratio decided by this Court in W.P.(C) No. 9060 of 2016 and batch, this Writ Petition may be disposed of in terms of the said Order.

In view of the above, this Writ Petition stands disposed of in terms of the Order dated 05.04.2017 passed by this Court in W.P.(C) No. 9060 of 2016 and batch.
