This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State. Perused the records. 3.
This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail.

Learned counsel for the Petitioner submits that the Petitioner is no way connected with the alleged offence, rather with an oblique motive the police has falsely implicated the present petitioner in this case.

On perusal of the F.I.R. it is found that, none of the offences are made out against the Petitioner.

Considering the nature of allegations, gravity of the offence and facts of the case, although I am not inclined to grant anticipatory bail to the Petitioner, however it is observed that, in the event the
// 2 // Petitioner surrenders before the learned S.D.J.M., Jharsuguda in 2(a)C.C. Case No.227 of 2022 corresponding to P.R. No.14/22-23 dated 09.04.2022 within a period of three weeks from today and moves for bail, he shall be released on bail on such terms and conditions as the learned Magistrate may deem just and proper in the facts and circumstances of the case, but subject to verification of the criminal antecedents of similar nature against of the Petitioner. 6.
The ABLAPL is disposed of accordingly.
