This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

Heard learned counsel for the Petitioner and learned Addl. Standing Counsel for the State.

This is an application under Section 438, Cr.P.C. filed by the Petitioner for anticipatory bail, involving offences punishable under Sections 379/34, I.P.C.

It is stated by learned counsel for the Petitioner that the Petitioner has not been named in the F.I.R. He further submits that the Petitioner is the owner of the land where the Mobile Tower of Reliance Jeo Company has been installed. It is further submitted by learned counsel for the Petitioner that though some materials from the site of the aforesaid Tower have been stolen by some anti-social persons, yet the Petitioner has been falsely connected with the aforesaid case.

Considering such submissions and the facts of the case, this Court directs that, in the event of arrest, the Petitioner shall be released on bail by the Arresting Officer in connection with Tikiri P.S. Case No.107 of 2022 corresponding to G.R. Case No.363 of 2022 pending in the Court of learned J.M.F.C., Kashipur, on such terms and conditions as deem just and proper in the facts and circumstances of the case.

The ABLAPL is disposed of accordingly.
