This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

This is an application under Section 439 of the Code of Criminal Procedure filed by the Petitioner for bail in connection with R.Udayagiri P.S.Case No.29 of 2021, corresponding to G.R.Case No.41 of 2021, pending in the Court of the learned Special Judgecum-Sessions Judge, Gajapati at Paralakhemundi for alleged commission of offences under Sections 20(b)(ii)C read with Sections 25 & 29 of the N.D.P.S.Act.

Heard learned counsel for the Petitioner as well as learned Additional Standing Counsel for the State.

Learned counsel for the Petitioner does not want to press this application at this stage. However, he seeks a direction to the trial Court to expedite trial and to conclude the same within a stipulated period. Accordingly, the bail application is disposed of as not pressed.

Learned trial Court is directed to make endeavour to conclude the trial expeditiously preferably within a period of six months. In

// 2 // the event trial is not concluded within the aforesaid period from the date of production of certified copy of this order, it is open for the Petitioner to renew his prayer for bail and in such event the bail application shall be considered without being influenced by any other factor.
