2. Heard learned counsel for the Petitioner.

The petitioner has filed this writ petition with the following prayer:- "It is, therefore, humbly prayed that your Lordships may be pleased to direct the State/O.Ps for counting the past service of the petitioner of the period of Jr. Soil Conservation Assistant from 29.2.1992 onwards together with the service rendered in the post of VLW from 2002 onwards an on completion of 20 years of service as on 29.2.2012, extend the benefit of 2nd RACP with effect from 1.1.2013 with Grade Pay of Rs.4600/- to the petitioner as per Finance Department Resolution dated 6.2.2013 under Annexure-5 and Finance Deptt.
clarification vide resolution dt.17.1.2015 under Annexure-6 and similar benefits extended to similar VLWs of NYAGARH, Saharanpur and Nuapada district under Annexure-8 series with fixation of pay."

The Petitioner has moved before Opposite Party No.1 seeking redressal of his grievances as made in the representation under Annexure-11 to the Writ Petition.

Considering the submissions made and without expressing any opinion on the merits of the case, this Court directs Opposite Party No.1 to take a decision on the above noted representation of the petitioner, in accordance with law and taking into account Annexure-8 series within a period of three months from the date of receipt of certified copy of this order and communicate the result thereof to the Petitioner.

With the aforesaid observation and direction the Writ Petition is disposed of.
