This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in T.R. Case No.35 of 2019, on the files of Additional Sessions Judge-cum-Special Judge, Koraput-Jeypore, arising out of Padwa P.S. Case No.85 of 2019, under Sections 20(b)(ii)(c) of the NDPS Act.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge-cumSpecial Judge, Koraput, by order dated 31.03.2022 in the aforementioned case, the present BLAPL has been filed. 5.
Taking into account the submission of learned counsel for the petitioner that trial has commenced, this Court is not inclined to entertain this bail application at this stage.

Since the petitioner is stated to be in custody since 25.11.2019 learned Court in seisin over the matter is called upon to conclude the trial within a period of four months from the date of receipt/production of the order.

In the event trial is not concluded within the time stipulated, it shall be open to the petitioner to renew his prayer. 8.
Accordingly, the BLAPL stands disposed of.
