This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in G.R. Case No.1229 of 2022, on the files of S.D.J.M. Berhampur, arising out of Gopalpur P.S. Case No.107 of 2022, under Sections 420/465/467/468/34 of IPC and is in custody since 13.07.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned 2nd Additional Sessions Judge, Berhampur, by order dated 04.08.2022 in the aforementioned case, the present BLAPL has been filed.

Learned counsel for the petitioner submits that co-accused has been released on bail by this Court by order dated 16.08.2022 in BLAPL No.7085 of 2022 and seeks release on the ground of parity.

Taking into account the release of the co-accused and the role ascribed to the petitioner, this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter.

Accordingly, the BLAPL stands disposed of.
