It is submitted by the learned counsel for the petitioner that the non-bailable warrant of arrest was issued in 2002 in connection with the present case i.e. G.R. No.187 of 2002 pending in the file of learned J.M.F.C., Pipili. It is further submitted that the petitioner did not have any knowledge about the case which has been registered under Sections 279 and 304-A IPC. It is submitted that in view of the above facts, the petitioner should be allowed to surrender and go on bail.

Considering the above submission and notwithstanding execution of NBWA pending for a long time, the Court is of the view that the petitioner should be directed to surrender and allowed to go on bail on such terms and conditions as would be fixed by the learned court below.

Consequently, the CRLMC stands disposed of with a direction to the petitioner to surrender before the learned J.M.F.C., Pipili on or before 31st October, 2022 in connection with G.R. Case

No.187 of 2002 and in the event he surrenders, the court shall release him on bail subject to conditions.
