This matter is taken up through hybrid mode.

Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner is an accused in C.T. Case No.687 of 2022, on the files of S.D.J.M. Balasore, arising out of Sahadevkhunta P.S. Case No.245 of 2022, under Sections 379 of IPC and is in custody since 27.07.2022.

Being aggrieved by the rejection of his application for bail U/s.439 Cr.P.C. by the learned Additional Sessions Judge cum Presiding Officer Special Court (SC & ST), Balasore, by order dated 04.08.2022 in the aforementioned case, the present BLAPL has been filed.

Perused the order of rejection.

Taking into account the nature of allegations and the punishment prescribed and keeping in view the period of custody,

this Court directs the petitioner to be released on bail on such terms to be fixed by the learned Court in seisin over the matter. 7.

Taking into account the criminal proclivity of the petitioner, it is directed that he shall appear before the jurisdictional police station once in every week till the submission of final form. 8.

Accordingly, the BLAPL stands disposed of.
