This writ petition involves a challenge to the inaction of the Order No.
Tahasildar in not making necessary endorsement in the Record of Rights involving the disputed land depending on a decision in allowing the proceeding U/s.8-A of the O.L.R Act.

Mr. Mohanty, learned counsel for the Petitioner referring to the communication at Annexure-5 submitted that even after the request of the Petitioner since 6.07.2022, no development on this issue is being taken place.

Considering the innocuous prayer made herein, this Court observes, in the event the order passed in the proceeding U/s. 8(A) of the OLR Act remains unchallenged; the Tahasildar is duty bound to make necessary endorsement in the Record of Rights without any further delay. This Court, therefore, finds strange in the action of the Tahasildar even in not making such endorsement even after filing of an application in this regard. In the process this Court while expressing its
// 2 // anxiety for moving of such type of writ petitions to the High Court, directs the Tahasildar to work-out the direction passed in the OLR Case No.137 of 2010 without any further delay and corrected record of rights shall also be handed over to the Petitioner within a period of fifteen days from the date of communication of a certified copy of this order by the Petitioner.

The writ petition stands disposed of with the above order. 5.
