This matter is taken up through Hybrid mode.

Petitioner in this CMP seeks for a direction for early disposal of CS No.162 of 2012-I pending before learned 1st Additional Senior Civil Judge, Balasore.

The stage of the suit is not clear from perusal of order sheet annexed to the CMP as Annexure-3. However, Mr. Das, learned counsel for the Petitioner submits that the suit is ready for hearing and there is no legal impediment for early disposal of the same.

In view of the above, this Court, without going into merit of the submission made by learned counsel for the Petitioner, disposes of the CMP with an observation that if the Petitioner so advised may file an application for early disposal of the suit stating the grounds therein. In such event, learned 1st Additional Senior Civil Judge, Balasore may consider the application for early disposal of the suit and proceed with the suit in accordance with law.
